Video footage clearly shows that plaintiff did not possess the cigarette butt. Plaintiff was then asked if he had any weapons on him, which he did not. Plaintiff was then searched, handcuffed, and placed in the back of a police vehicle without reasonable cause. Plaintiff asked why he was being arrested and was told he would find out when he got to the precinct. Plaintiff was photographed and fingerprinted at the precinct, and held there for several hours without being told why. He was then charged with criminal possession, and wrongly incarcerated for 2 to 4 days before making bail.
