During a dispute, the tenant grabbed plaintiff by the neck and choked him. Plaintiff left and called 911 to report the assault. Defendant NYPD Officers Megan Finnerty, Andrew Neura, Gabriel Abreu, Daniela Berge, Michael Valverde, and Johnathan Badillo arrived on scene, and after arresting the tenant and observing the injuries to plaintiff, also placed him under arrest, despite having no cause to believe he had done anything illegal. Defendants placed plaintiff in extremely tight handcuffs and ignored his requests to loosen them. They then transported plaintiff to the 115th Precinct, and placed him in a holding cell for several hours.
