Mr. Babadaglian was operating a motor vehicle then and was trying to maneuver around a double-parked car when Officers Bleck, Rivas, and John Doe #1 drove towards him – Mr. Babadaglian gestured out his window, indicating that he was trying to pass the double-parked vehicle but Officer Rivas, who was in the driver’s seat, rolled down his window and confronted Mr. Babadaglian, asking him what his problem was. Mr. Babadaglian had no idea and had no reason to know that Officer Rivas was a NYPD officer at that point in time – he asked, rhetorically, if Officer Rivas was stupid. At this point in time, Officer Rivas rolled the driver’s side window further down – Mr. Babadaglian observed the NYPD patch on his jacket. No further words were exchanged and the officer’s vehicle continued past Mr. Babadaglian’s vehicle – Mr. Babadaglian was able to drive around the double-parked car and proceed on his way. After Mr. Babadaglian had driven half a block, the officers made a U-turn and began to follow him – they pulled him over on Austin Street, in the vicinity of 70th Road. Officers Bleck and Rivas opened the driver’s side door, pulled Mr. Babadaglian (an elderly who suffers from Parkinson’s disease) out of his car and dragged him to the back of his car then hit the left side of his face against the top trunk area and slammed his chest against the car. Officer Bleck kneed Mr. Babadaglian, causing his knee to hit the car; Officer John Doe #1 held Mr. Babadaglian as he was roughly handcuffed in a manner that caused swelling to his wrists and arms. Mr. Babadaglian told the officers that he was in pain and requested that they ease it but was ignored by the defendants. Mr. Babadaglian and his vehicle were then searched. Mr. Babadaglian was brought to another nearby street in Queens in the vicinity of 70-30 Austin Street. The officers parked the vehicle and left Mr. Babadaglian handcuffed in the back seat – he remained there until Officers John Doe #2 (a supervisor) and John Doe #3 and #4 arrived, all in plain clothes, and he was taken out of the car and his handcuffs were removed. Mr. Babadaglian was then released at the scene with a summons – he was charged by Officer Bleck with disorderly conduct and intentional obstruction of vehicular traffic while shouting obscene language that caused a crowd to gather.
