Plaintiff was alone and waiting for an uber to take him home. While he was walking and waiting a crowd of people began running in all directions around him the defendants approached him. Plaintiff was struck in the back of the head with a baton by a defendant. This startled plaintiff and he tried to run when he was struck by another defendant. Plaintiff was then tackled to the ground and punched and kicked repeatedly before being tightly handcuffed. Officers present that did not participate failed to intervene to prevent any of these acts. The entire incident was caught on a bystander's cell video. Plaintiff was searched by defendants and no contraband was found. Plaintiff was transported to the precint were he was held for 30 hours before being released. Plaintiff was subject to the negligent infliction of emtional distress. Defendants provided false and misleading information to the District attorney's office. Plaintiff lost a new job due to the impending criminal allegations.
