As Plaintiff was stating his legitimate purpose,  Defendant Goulart threw him against the police car and began an illegal search, including unbuckling Plaintiff’s belt and without consent placing his hands in Plaintiff’s underwear.  Defendant Goulart forced Plaintiff to remove his shoes, and then allegedly found a small packet of marijuana in a sweatshirt Plaintiff had been carrying.  Plaintiff was handcuffed on the sidewalk and held in a police van for over two hours with others accused of marijuana possession.  Plaintiff was taken to the 52nd Precinct where he was strip searched and forced to squat naked in front of officers.  Plaintiff was held for over 24 hours before being released, and none of his personal property was returned.  Defendant Goulart provided false information in his reports that the marijuana was in public sight.  All charges were dismissed on February 20, 2014 after Plaintiff was forced to appear 14 times. \n\nOn August 16, 2011, Plaintiff Christopher Medina had buzzed his friend’s building door when an unmarked police car stopped and reversed back to him.  Defendant Nicholas Levesque and others surrounded him and began an illegal search and non-consensual search that recovered a small amount of marijuana from Plaintiff’s pants pocket.  Plaintiff was handcuffed and transported to the 46th Precinct, where he was charged on the false statement of Defendant Officer Levesque that the marijuana was in public view.
