Ortiz and his mother approached her apartment so that he could use the bathroom, when Tirado opened the door and asked the Plaintiff if he lived there. The Plaintiff answered that he used to live there, and pointed to a family portrait. The NYPD refused to allow him to use the restroom and ordered him to leave. Plaintiff's mother confirmed that she lived there and asked if Tirado had a warrant. Instead of answering, Tirado placed her in handcuffs. Plaintiff asked Det. Cote and Calloway why his mother was being arrested and was ignored and not shown a warrant. Plaintiff began filming the incident and repeatedly told the officers that his mother was sick. Det. Cote told him that he could film, but he was too close, even though Plaintiff remained 10-15 feet away from the officers and his mother. Calloway then grabbed Plaintiff's armed and attempted to take his camera. Calloway and Cote used their bodies to shepherd the Plaintiff away from this incident, where he could no longer record. Plaintiff continued to try to film and requested the officers use \"no force.\" Officers then told him that he was required to leave \"by law.\" Calloway then twisted the plaintiffs arms behind his back and pushed his legs so that he fell to the ground and could no longer record. Cote and Calloway jumped on his back and held him on the ground while another officer repeatedly kicked Plaintiff's leg. \n\nThe officers then handcuffed the Plaintiff and placed him in a non-air conditioned van for over an hour before transporting him to the precinct. While he was being walked to the precinct, another officer John Doe told the Plaintiff that asking for a lawyer or medical attention would \"slow down the process.\" Plaintiff was arraigned and charged on June 12, 2015 with Second Degree Obstructing Governmental Administration and Resisting Arrest.
