Plaintiff saw a gas station on 96th Street and pulled into the station. After parking her vehicle, Plaintiff asked if there was a line to purchase fuel, and was told that there was. Defendant approached plaintiff and instructed her to move her vehicle because she was not on line to purchase fuel. Plaintiff complied. Plaintiff drove her vehicle to the back of the line for fuel. Defendant again approached plaintiff and told her to get off the line for fuel. Plaintiff asked for defendant's badge number, precinct and supervisor's name. Defendant replied by saying he would tell his supervisor plaintiff hit him with her vehicle, which was a lie. Defendant implied plaintiff was threatening him and feigned being injured by plaintiff, and made a radio call that he had been hit by her vehicle, which was another lie. Numerous other NYPD vehicle arrived, and plaintiff was arrested and taken to the 103rd precinct. Plaintiff was taken to NY Central Booking, and charged with several offenses. Defendant created paperwork containing false allegations that were provided to the DA who brought criminal charges against plaintiff. Plaintiff was released on November 1, 2012. On April 9, 2013, the prosecution against plaintiff was adjourned in contemplation of dismissal.
