Prior to January 16, 20[19], Defendant Detective Jonathan Thomas contacted plaintiff  and demanded that he present himself at the 113th precinct to discuss Monique Patrick. At Det. Thomas' command, on the morning of January 16, 2019, Plaintiff presented himself at the 113th precinct and was immediately arrested by Det. Thomas and placed in a holding cell for approximately 2 hours. Despite actual knowledge of plaintiff having retained counsel, Det. Thomas interrogated plaintiff in the holding cell. Det. Thomas told plaintiff he was being arrested for aggravated harassment against Monique Patrick, despite having no proof. In fact, plaintiff told Det. Thomas plaintiff himself had previously filed a complaint against Monique Patrick and her son for harassment with proof of the text messages.\n\nDespite plaintiff advising Det. Thomas that Monique Patrick was known by NYPD to make false allegations, and without any evidence, Det. Thomas imprisoned and arrested plaintiff, and searched, handcuffed, fingerprinted, photographed and processed plaintiff at the 113th precinct. Plaintiff had no contraband on him and did not have any outstanding warrants. Plaintiff was ever provided his Miranda rights. On January 16, 2019, on or about 9PM, plaintiff was arraigned and released on his own recognizance. Plaintiff Carter observed NYPD Officer Thomas and several unidentified NYPD officers speak to and chase another individual regarding a matter unrelated to him. While Plaintiff Carter was in front of his building, the NYPD officers grabbed him, arrested him without probable cause, and threw him into a marked vehicle. While Plaintiff Carter was in handcuffs, Officer Thomas said to him, “I should fuck you up because he got away,” and punched him in the face. Plaintiff Carter was taken to the precinct; he was released from Brooklyn Central Booking at around 5:00 p.m. the next day after being arraigned. The NYPD officers fabricated and forwarded false information to prosecutors. The criminal charges were ultimately resolved via an ACD.\n\nOn July 31, 2013, at approximately 6:00 p.m., Plaintiff Derrell Derby (an African American male) was walking down to the corner of Decatur Street and Albany Avenue in Brooklyn. Plaintiff Derby stopped to sit on a stoop approximately 50 feet away from his house. While Officer Thomas chased the other individual described above, 10-12 marked vehicles arrived at the corner. Officer Thomas returned to the scene, approached Plaintiff Derby, and grabbed him by the arm. Approximately 6 unidentified NYPD officers grabbed him by the arms and legs. They forced Plaintiff Derby to the ground and sat on him. Plaintiff Derby was handcuffed, placed in a marked vehicle, and taken to the 81st Precinct. Plaintiff Derby requested medical attention, but his request was denied. Plaintiff Derby was brought to Central Booking at 3 a.m. The NYPD officers fabricated and forwarded false information to prosecutors.
