Plaintiff was at his mothers house, where he lives, when he had a manic episode. As a result, Plaintiff's sister called 911 advising the dispatcher that Plaintiff suffered from mental illness and they needed EMS and police officer assistance. Defendant Officers Bipul Barman and MD Shah, and Charles Dever arrived on the scene. When asked to speak with Plaintiff, they were informed that Plaintiff walked out the front door. Plaintiff's family offered to go with the Defendant officers in order to calm Plaintiff down, but the officers refused stating that they would \"handle it.\" Just as Plaintiff's family feared, upon seeing the officers following him Plaintiff became fearful for his life and began to run away from them. Defendant officers chased after Plaintiff screaming and cursing at him. This led to such much distress that Plaintiff began to run into an intersection where he was struck by a truck that knocked him unconscious. \n\nPlaintiff was taken by ambulance to the hospital where he was diagnosed with a multifocal intracranial hemorrhage and a traumatic brain injury. Moreover, Plaintiff was diagnosed with left displaced T1/TP fracture in his thoracic spine, a left central disc protrusion at C6/C7, acute displaced bilateral clavicular head fracture, acute left orbit superolateral frontal bone fracture, displaced fracture of his 2-5 left ribs, and a dorsal radial laceration of his left hand.
