Plaintiff Foxworth was grabbed from the vehicle and placed in handcuffs. Plaintiff Nieuenkirk was thrown into a police car where he was assaulted and battered once again by POs. Plaintiffs Nieuenkirk and Foxworth were taken to the 71st Precinct. While there PO Terrell threatened Plaintiff Nieunkirk with punishment of Plaintiff Foxworth if he sought medical attention for his injuries. Plaintiff Foxworth was released later that evening without being charged with a crime. Mallilo, with unidentified officers, were executing a search warrant, and forcibly entered into the subject remises by breaching the front door with a \"rabbit tool\". Joseph was the subject of the search warrant. Before Mallilo and other officers searched the premises, plaintiffs were placed in handcuffs and placed in a police van. Plaintiffs were driven around for six hours, then taken to the 71st police precinct. Plaintiffs were issued DATs and released from custody. On August 18, 2017, plaintiffs reported to Red Hook Community Justice Center and informed by clerks the DATs were not \"meant for\" them, and directed to Brooklyn Criminal Court. At Brooklyn Criminal Court, plaintiffs were informed the Brooklyn DA had not made a decision on their matters and they should expect to receive a communication from the DA within thirty days. Defendants arrested plaintiff, and plaintiff was transferred in custody. \n\nAt the 71st Precinct, defendant-NYPD officers continued to ridicule plaintiff, including referring to the plaintiff with a slur historically and derogatorily lodged against lesbians. Plaintiff was processed, possessions (car keys, call phone charger, Android Tablet, and prescription bottle of methadone). On January 8, plaintiff was subsequently arraigned for criminal possession and unlawful dispensing of a controlled substance based on the false allegations provided by NYPD-defendants. Plaintiff received no medical attention during this time, and experienced withdrawal symptoms. Defendant-NYPD officers Steven Fursa (Shield No. 1245) and Paul T. Mallilo (Shield No. 2575) are named generally as parties to the suit, but the complaint (amended) does not place either officer specifically in each interaction. On or about October 2, 2017, all charges against the plaintiff were dismissed.
