Plaintiff was punched, pushed, slammed to the ground, and handcuffed in his home during this arrest. At no point did Plaintiff resist arrest. Plaintiff was not informed of his Miranda rights after his arrest, and was taken to Bellevue Hospital on the evening of September 12, 2011 (following his arrest) for psychiatric evaluation because he was refusing to speak with police. Following Plaintiff's arrest, and also on September 12, 2011, Officer Pabon obtained a warrant to search Plaintiff's home, which he obtained by falsely stating that Plaintiff had been positively identified as the assailant in a sexual assault that took place in a park near Plaintiff's home that day (when the woman had identified her attacker as a \"tall black man\") and by stating that he had spoken to Plaintiff about the assault when he was in Plaintiff's home. Plaintiff was arraigned on September 13, 2011, and released to his home after paying bail, around 2:00 AM on September 14, 2011. Because his door had been knocked down during his arrest, there were an unidentified number of officers stationed outside his door when he returned home, one of whom was Officer Ungcharoen. Plaintiff entered his home, and around 5:00-6:00 AM he heard Officer Ungcharoen knocking on his broken front door. When Plaintiff went to the door to meet Officer Ungcharoen, Officer Ungcharoen informed him that he was being arrested on the false charge of escaping, which is a felony. Plaintiff was arraigned on the false escape charge, and because this was a felony he was denied bail and incarcerated at Riker's Island pending his trial. \n\nThe felony arrest complaint that Officer Ungcharoen submitted, which stated that Plaintiff was apprehended at the front door to his home, was replaced with a separate felony arrest complaint signed by Captain Farrell, which stated that Plaintiff was apprehended while climbing the fence in his backyard. Only the second complaint was submitted to the grand jury by Assistant D.A. Holderness, and when the judge discovered this, he granted Plaintiff bail - which would have released him from custody pending trial. However, Assistant D.A. Holderness and other \"Doe\" Assistant D.A.s successfully argued against Plaintiff receiving bail by invoking an unrelated August 2011 arrest. As a result, Plaintiff was incarcerated at Riker's Island for four years pending his trial, during which time he faced mental and physical abuse from numerous Doe Corrections Officers.
