Plaintiff operated his motor vehicle at the aforementioned location after DJing at a local restaurant. At said time and place plaintiff was stopped by the defendants, including police officer Warren Golden, and falsely accused of operating his motor vehicle in an unsafe manner and being intoxicated. Defendants' then arrested Mr. Corbin and transported him to the 45th precinct. After searching him and his wallet, the defendants found two lawfully issued conceal and carry licenses from other states.\n\nUsing this as the sole predicate and without a warrant, they searched his vehicle and found a locked box underneath or about the back seat. The box was not in plan site. Upon opening it, defendants found a handgun lawfully owned by the plaintiff. Thereafter, plaintiff was directed to take a breathalyzer test in which came back negative for alcohol. Nevertheless, defendants\ncharged the Plaintiff with a multitude of crimes including while intoxicated. Plaintiff was transported to central booking, and later released on his own recognizance.
