Prior to this date, from approximately June 21, 2011, to March 23, 2012, Defendants conducted a drug-related law enforcement operation and falsely claimed that Plaintiff Walker was present and involved in an unlawful drug-related activity on or about December 1, 2011, and December 12, 2011. Plaintiff Walker was no in New York State on the aforementioned dates, nor was he involved in any alleged unlawful activity. Defendants falsely identified Plaintiff in photo arrays on or about December 28, 2011, and February 2, 2012. Defendant Depalo conducted these photo arrays under the supervision of Defendant Logan. \nOn the day of the incident, March 13th, Defendants Gamble and Doe demanded information from Plaintiff Walker, who identified himself and provided the Officers with his ID, and forcefully pulled Plaintiff outside of his home against his will. Defendant Gamble unlawfully seized Plaintiff Walker, searched his person, and Defendant Duage led him away from the house in handcuffs. Defendant Officers acted upon false information fabricated by undercover officers. Plaintiff was taken to the 81st Precinct where he was processed and charged with 3 felonies and a class A misdemeanor. Plaintiff was detained at Rikers Island for 9 days and on March 23, 2012, was released on a $25,000 bond. On October 10, 2012, all charges were dismissed on the application of the Kings County DA's Office.
