Ms. Dirden had previously threatened Plaintiff's life, broken his personal possessions, and spit on Plaintiff while she resided with him earlier in the year. Due to her actions, Plaintiff had an order of protection, which among other items required Ms. Dirden to be accompanied by officers when removing her personal belongings. On or about August 2, 2017 Ms. Dirden entered Plaintiff's home with 2 POs to retrieve her personal belongings. On or about August 11, 2017 Ms. Dirden returned without POs and attempted to enter Plaintiff's residence, which Plaintiff refused and Ms. Dirden was arrested as a result. Ms. Dirden then returned on or about August 25, 2017 with POs to retrieve her belongings. Plaintiff showed the order to POs and explained the previous events, and in fact recognized PO Leslie as a PO who came to his residence during the August events. \n\nPO Leslie informed Plaintiff he was under arrest for assault on Ms. Dirden. Ms. Dirden fabricated the assault in retaliation for the order of protection, and Plaintiff protested the lack of reasonable basis for the arrest. Plaintiff also explained he had prescribed medication he had to take before leaving his residence. PO Leslie refused to allow Plaintiff to take his medication. Plaintiff was instead placed in handcuffs and brought outside in view of his neighbors. POs transported Plaintiff to Criminal Court where he was criminally processed and held for approximately 19 hours. Plaintiff was not allowed to eat for 9 or 10 hours and was denied his prescribed medication during his 19 hours of unlawful incarceration. Plaintiff was detained in a cell with a strong odor of urine and feces and a concrete floor crawling with insects. After 19 hours PO Leslie informed Plaintiff the District Attorney had dropped the charges against him and Plaintiff was released through a back door on September 8, 2017.
