Defendants woke up Plaintiff Kalish, Vargas, Almanderez, David and Miranda at gunpoint suffered emotional trauma, physical pain and suffering and humiliation among other injuries. Plaintiffs were falsely arrested and detained against their will. Defendant's used unnecessary force to search detain and arrest plaintiffs and Plaintiffs suffered personal injuries, negligent and intentional infliction of emotional distress, anxiety, fear, damage to their reputation. Defendants also unlawfully took Plaintiff Victor's ta Bulova watch. The individual Defendants also failed to intervene or prevent the unlawful home entry, use of force, search, assault etc of Plaintiffs. The defendants ordered him to pull over, and when he exited his car, they harshly slammed him against the car, handcuffed him, and brought him to a prisoner van. At the van, one defendant officer intentionally slammed the door into Mr. Ward's face, and when the defendants forced him into the van, his head slammed against one of the seats and his lip was sliced by a metal object protruding from the seat. Inside the van, the defendants invasively searched Mr. Ward's body, which included pulling down his pants and manipulating his genitals. Mr. Ward was then brought to a police precinct, where he was refused medical treatment after requesting it due to pain and injuries he suffered during the arrest. After the precinct, Mr. Ward was taken to Brooklyn Central Booking, and only then was he brought to a hospital for treatment (before being returned to Central Booking). After 24 hours in custody, Mr. Ward was released from Central Booking without any explanation for why he had been arrested. Defendant O’Leary made false statements to the Kings County DA’s Office, causing plaintiff to be prosecuted under Kings County Criminal Court on false charges. Plaintiff was arraigned in Kings County Criminal Court, and criminal charges were adjourned in contemplation of dismissal.
