The Defendants further illegally searched the Plaintiffs, strip searched Plaintiff Cruz, handcuffed and interrogated the Plaintiffs. The Defendants then \"ransacked\" the apartment, causing damage to the personal belongings of Plaintiffs Rosario, Concepcion and Claus. The Defendants then transported Plaintiffs Claus and Cruz to the local precinct and ultimately to central booking. The Defendants set forth fabricated charges against Plaintiff Cruz, initiating a criminal prosecution against him for the possession of marijuana. The charges against Plaintiff Cruz were ultimately dropped. However, Plaintiff Cruz was held in custody for 19 days AFTER the charges were dropped. Plaintiff Claus spent two days in police custody. Plaintiff Cruz spent 21 days in custody. As he approached his house. the plaintiff was approached by defendants. The defendants grabbed Mr. Holiday by his throat, threw him to the ground, and proceeded to assault him. The plaintiff had committed no criminal activity, nor did the defendants have probable cause or reasonable suspicion that plaintiff had committed any criminal activity. Mr. Holiday did not attempt to resist arrest, nor to assault the defendants in any way. The defendants struck plaintiff with their fists and kicked him repeatedly for several minutes. When the defendants finally ceased the assault, and began to taunt plaintiff. Defendants made jokes about how much blood plaintiff had lost. Following the assault, the plaintiff’s need for medical attention was apparent, however defendants did not take any steps to obtain medical attention for Mr. Holiday. Defendants entered plaintiffs’ home without a valid warrant, consent, or other legal basis to enter their home. Plaintiff Mrs. Holiday who is Mr. Holiday's mother objected to the officer's presence in her home. She was detained for the duration of the officer's search of her home. After not finding any contraband, defendants left plaintiffs' home and brought Mr. Holiday to the precinct. Mr. Holiday was treated at Woodhull hospital for serious injuries including fractures to his 8th, 9th, 10th, 11th and 12th ribs, subconjunctival hemorrhages causing him to bleed from both eyes, swelling to both eyes, head trauma, and numerous cuts and bruises. The plaintiff remained at the hospital for approximately four days. Based on the false allegations made by defendants, Mr. Holiday was charged with petit larceny, possession of stolen property, assault in the third degree, resisting arrest, criminal possession of a weapon, and harassment in the second degree. Mr. Holiday was arraigned and assigned $500 bail. All charges against Mr. Holiday were later dismissed.
