A group of 3 or 4 John Does NYPD Police Officers, including Police Officer William Smith and Police Officer William Garcia, started questioning Plaintiff and searched, handcuffed and arrested Plaintiff for trespassing, despite the family friend confirming that there was no problem with Plaintiff's presence in the building.  At the precinct, Plaintiff was subjected to an invasive strip search by two of the arresting John Does Officers, including Officer Smith.  Plaintiff's brother came to the precinct and told the John Does Officers that Plaintiff was in the building to visit him with his permission, but the John Does Officers were uninterested.  Plaintiff was held in custody at the precinct overnight before being transported to Central Booking in the police van, handcuffed with excessive tightness for a long period of time.  Officer Smith completed the criminal court complaint, fabricating the factual allegations and charging Plaintiff with trespass and criminal trespass in the second and third degree.  Plaintiff was held in custody until he was arraigned on November 11, 2012, and released on his own recognizance.
