The peaceful protest was organized after the deaths of Breonna Taylor and George Floyd in May 2020. Plaintiffs identified themselves as lawmakers to police officials before and during the protests. Shortly before 8 AM, the defendant NYPD officers broadcast a message to the protesters, telling them to disperse, despite having no legal basis for this order. Plaintiffs attempted to comply with these commands, but the NYPD officers \"kettled\" them in place, leaving them with nowhere to go.\n\nDefendant officers including Defendand Ciota then began to use their bicycles to assault Plaintiffs and other protestors, ramming their legs, abdomen, and pelvic area. The officers, including defendants Clinton, Perez, Kovalik, Bemudez, and Ciota then sprayed plaintiffs with pepper spray, blinding plaintiffs and knocking Plaintiff Richardson to the ground. No defendants attempted to give medical assistance to plaintiff Richardson. Meanwhile, defendants Taylor and Calderon arrested plaintiff Myrie without probable cause and refused to offer him medical assistance. Defendant officers Kovalik, Ciota, Bermudez, Ventrella, Olfano, and Kerr failed to intervene in the unlawful conduct against both plaintiffs. Plaintiff Myrie was eventually identified as an elected official and was released from custody. The plaintiffs then left the scene of the protest. Additionally, about a year later, on September 9, 2013, the defendant officers stopped, detained, harassed, assaulted and arrested the plaintiff without cause while outside in Brooklyn.\n\nOn August 2, 2012, the plaintiff was engaged in a conversation with a friend when the defendant officers drove past them in a police vehicle. The officers then made an abrupt illegal U-turn to approach the plaintiff. The defendants began questioning the plaintiff and one of them asked the plaintiff \"don't I know you?\" The plaintiff informed the defendant officers that he didn't know any of them. Defendant officers then began to grab the plaintiff and reach into his pockets. The plaintiff requested that the defendant officers leave him alone as they were grabbing, turning pushing and pulling him. They refused and began to pounce on him and beat him up. The defendant officers proceeded to empty/spray several chemical agents onto plaintiff's face. Not contended, the defendant officers targeted and repeatedly punched the plaintiff in his periocular area causing the plaintiff to sustain, among other injuries, an orbital fracture and to experience diplopia. The defendant officers also kneed the plaintiff in his stomach area causing the plaintiff to pass blood in his urine, and forcibly dragged the plaintiff down to the ground. Eventually, defendant officers tightly handcuffed the plaintiff with his hands placed behind his back and forcibly pushed the plaintiff into a police vehicle. Plaintiff was rendered dizzy and unconscious as a result of the defendant officers' actions. Plaintiff was later transported to the NYPD Housing Bureau's PSA-2. Initially, defendant officers denied plaintiff's request for medical treatment, but, after a lengthy period of time plaintiff's conditions worsened and the defendant officers were forced to transport the plaintiff to a hospital. The defendant officers seized the plaintiff's belongings and did not provide him with any means to obtaining them again. Plaintiff was charged with resisting arrest and subsequently released. \n\nPrior to his second arrest on September 9, 2013, the plaintiff was eating dinner at his home with one of his friends when the defendant officers suddenly and unlawfully entered the plaintiff's home, arrested him and charged him criminal possession of a weapon. Defendant officers tightly handcuffed the plaintiff (which caused the cuffs to cut into plaintiff's skin) and denied each of plaintiffs' requests to loosen the handcuffs. The plaintiff was taken to the 77th Precinct and then transported to Central Booking to await arraignment. The defendant officers falsely stated to the prosecutors, among other things, that the plaintiff was in possession of a weapon. The prosecutors conducted an independent investigation and concluded that there was no evidence to support the defendant officers' claims, so the prosecutors declined to prosecute the plaintiff.
