After entering the plaintiff's residence, the officers physically seized plaintiff, pointed weapons at him, forced him to the ground, applied handcuffs to him, and searched his residence without his permission or consent. During the search, officers seized and took possession of approximately $10,000 in cash and jewelry belonging to plaintiff, which they have not returned. On or about December 6, 2019, the officers initiated or caused to be initiated criminal charges against the plaintiff based on claims the officers knew to be false. Officer Yu signed a Criminal Court Complaint in which he made allegations against plaintiff that were false and that he knew to be false, including the allegations that he had recovered drugs from the plaintiff's residence. On or about December 6, the officers also initiated or caused to be initiated a civil action with the New York State Office of Children and Family Services, Child Protective Services, falsely and maliciously accusing plaintiff of possession of and/or selling drug from his residence in the presence of a minor child. As a result of this action, plaintiff risked losing custody of his minor child, and had his Taxi & Limousine Commission license suspended, which prevented him from continuing in that line of employment.
