Plaintiff was approached by an employee who told her to leave. Plaintiff explained she was waiting for her husband but the employee and other employees still directed her to leave on the basis of her perceived race. Plaintiff responded she had a right to remain where she was and employees called the NYPD. POs, including PO Daniel Sandberg, responded and directed Plaintiff to leave the restaurant. POs, including Sandberg, then grabbed Plaintiff, forcibly dragged her to the ground, handcuffed her, and physically removed her from the restaurant, detaining her on the pavement outside in the rain. POs, including Sandberg, then had Plaintiff transported to a hospital without legal justification. Plaintiff remained detained at the hospital for several hours until she was released from custody later that day. PO Sandberg caused a malicious prosecution to be undertaken against Plaintiff and falsely stated Plaintiff hit, kicked, and tried to bite POs.
