Defendant Marlyn Armand was the owner of one vehicle, which was left unattended with the keys still in it. Defendant Stephen Brumaire, employed by the Dept. of Corrections, operated this car with permission (express and/or implied) from Marlyn Armand. Marie Armand was the owner and user of the second vehicle. Following this collision, which was caused by the negligence and recklessness of the defendants, one of the vehicles came into violent contact with Plaintiff Charlotte Nurse, mother of infant plaintiff Michael Nurse, who was a pedestrian bystander.  Nurse was seriously injured during this crash. During the raid, the officers, inter alia, pointed guns at Plaintiffs, performed illegal detentions and searches, failed to provide Miranda rights, used excessive force, failed to allow Plaintiffs to put on proper clothes before they were taken outside, and unlawfully arrested several of the Plaintiffs. Once all residents had been removed from the premises, officers, without consent or a warrant, conducted a full search of the premises that went on for several hours. Later, after returning to the premises, the Plaintiffs found that the premises was severely damaged and that their personal property was missing and/or broken. At the time the complaint was filed, one of the Plaintiffs had not received his confiscated wallet and keys back.  \n\nIn connection with the raid, several of the Plaintiffs were transported to the precinct, where they were held for hours, and then to central booking. All of the Plaintiffs who were brought to the precinct and central booking, except two, were released without being arraigned or charged. The two other Plaintiffs were charged and arraigned; their charges were still pending at the time the complaint was filed and they had pled not guilty to all charges.
