PO Pierre Fontaine, Lt. Peter O'Neill, and unnamed POs responded and, without legal justification, assaulted, attacked, and verbally abused Plaintiff. Plaintiff sustained, inter alia, blunt head trauma as well as lacerations and bruises to the face, eyes, head, and neck as a result of the attack. Plaintiff was falsely arrested for assault and taken to the hospital, 60th Precinct, Central Booking, and ultimately Rikers Island. POs, including Fontaine and O'Neill, intentionally caused a malicious prosecution to be commenced against Plaintiff, who was wrongfully held in police custody until October 10, 2011. On or about February 25, 2013 all charges against Plaintiff were dismissed.
