They also searched Plaintiff's car without consent. No searches produced evidence of anything illegal. When Plaintiff inquired why his vehicle was being searched, a PO pushed him. When Plaintiff asked why he was being pushed, the PO pushed him again with greater force. Plaintiff attempted to protect himself, and ultimately numerous officers responded and attacked him. Plaintiff was slammed to the floor, where he was further beaten. The beating continued as Plaintiff was handcuffed. Plaintiff was transported to the 52nd Precinct, where his requests for medical assistance were ignored. After being held for 2 - 3 hours, Plaintiff was released with a summons for disorderly conduct and he sought medical treatment the next day. Prosecutors found no basis to charge plaintiff with felony assault and declined to prosecute him for this offense. Mr. FONTANEZ-BATISTA was eventually arraigned was given an adjournment in contemplation of dismissal. Despite the lack of a warrant, no exigent circumstances, and plaintiff not having committed any crime, defendants ignored plaintiff's protests that he was a lawful resident of the apartment, and also disregarded his keys, photo ID, and documents containing his name. The NYPD officer defendants collectively handcuffed plaintiff too tightly, forcefully dragged him from his home, and threw him face first into a police vehicle. The NYPD officer defendants falsely claimed that plaintiff had burglarized the department. Plaintiff could not make bail, was indicted for burglary, public lewdness, and criminal trespass on June 1, 2018, and was incarcerated in an NYC DOC facility for five months. While incarcerated, plaintiff was attacked by other inmates. The Bronx District Attorney's office made an application to the court on October 16, 2018, to have plaintiff immediately released on his own recognizance, and then on October 25, 2018, provided plaintiff's attorney a written Brady/Giglio disclosure that a witness informed them plaintiff was a lawful resident of his apartment. The indictment was dismissed and sealed on the Bronx DA's office's motion on February 28, 2019. Plaintiff Adetimirin was held for a few hours before being given a summons charging him with Disorderly Conduct. After approximately seven hours in custody, Plaintiff Benoit was released from Central Booking with no charges being formally brought against him. Both plaintiffs sought medical attention for their injuries.
