Earlier in the evening, Plaintiff and two others were invited to visit a resident of 1435 Ogden Avenue. As Plaintiff and the two other guests were leaving the residence, Defendant POs stopped, questioned, and frisked Plaintiff without reasonable suspicion or probable cause. One of Plaintiff's friends who was with him explained to Defendant POs that the three of them were invited to the building as guests of a resident and that they were presently exiting the building. Defendant POs continued to question Plaintiff despite knowing the reason for his presence in the building, and unlawfully ordered Plaintiff to provide him with identification. Defendant POs then directed Plaintiff outside to their squad car and made him stand outside on the cold for one hour while they searched for warrants or a criminal history. Both searches came back negative. After spending a few hours at the apartment, the plaintiff left the residence and began descending the building's stairs when the plaintiff encountered the defendant NYPD officers.  Without legal justification, the officers stopped the plaintiff and frisked him over his clothing, touching all areas of his body.  The officers found no weapons, drugs, or other illegal contraband on the plaintiff.  Despite finding no contraband on the plaintiff, the officers questioned him for fifteen minutes, asking him for the reason why he was present in the building.  The plaintiff told the officers that he was visiting his friend, who leases an apartment there.\n\nInstead of confirming the accuracy of the plaintiff's statement, the officers asked the plaintiff to see his ID, an order that the plaintiff complied with.  Then, without any basis for accusing the plaintiff of any crimes, the officers accused the plaintiff of trespassing in the building and ordered him to accompany the officers to their squad car outside of the building.  The plaintiff then stood outside in the cold for an hour while the officers searched to see if the plaintiff had any outstanding warrants or a criminal history.  He did not.  Nevertheless, the officers issued the plaintiff a summons which contained fabricated information.
