The peaceful protest was organized after the deaths of Breonna Taylor and George Floyd in May 2020. Plaintiffs identified themselves as lawmakers to police officials before and during the protests. Shortly before 8 AM, the defendant NYPD officers broadcast a message to the protesters, telling them to disperse, despite having no legal basis for this order. Plaintiffs attempted to comply with these commands, but the NYPD officers \"kettled\" them in place, leaving them with nowhere to go.\n\nDefendant officers including Defendand Ciota then began to use their bicycles to assault Plaintiffs and other protestors, ramming their legs, abdomen, and pelvic area. The officers, including defendants Clinton, Perez, Kovalik, Bemudez, and Ciota then sprayed plaintiffs with pepper spray, blinding plaintiffs and knocking Plaintiff Richardson to the ground. No defendants attempted to give medical assistance to plaintiff Richardson. Meanwhile, defendants Taylor and Calderon arrested plaintiff Myrie without probable cause and refused to offer him medical assistance. Defendant officers Kovalik, Ciota, Bermudez, Ventrella, Olfano, and Kerr failed to intervene in the unlawful conduct against both plaintiffs. Plaintiff Myrie was eventually identified as an elected official and was released from custody. The plaintiffs then left the scene of the protest. Later that day, two different unnamed NYPD officers arrived at the apartment. Plaintiff asked why they were there and was given no explanation. The officers claimed to have no knowledge of the earlier altercation. Sergeant Shaun Brown then arrived at the apartment along with Officer Michael Caracciolo. Sergeant Brown stated that he was going to \"examine [the female roommate's] body,\" before entering her bedroom, closing the door, and remaining inside for 20 minutes. When he came out, he instructed the unnamed officers to arrest Plaintiff. Plaintiff was transported to Brooklyn Central Booking where he was arraigned there on 10 criminal charges, including 3 felonies. He filed a report against his roommate and the detective assigned to the report stated that \"the precinct had already taken a position on the matter.\" Plaintiff also filed a complaint with the NYPD Internal Affairs Bureau, which failed to materially investigate his claim or speak with the officers from the earlier altercation to substantiate Plaintiff's account. On November 9, 2015, the assistant district attorney stated to the court that he contacted Officer Vasco and that the \"complaining witness\" lacked credibility. Plaintiff could not travel that evening and in the morning went back to his apartment to find it in horrible condition. The police officer has destroyed Plaintiffs door and searched Plaintiffs apartment, ransacked the place and broke a number of things. \n\nPlaintiff has settled a claim with NYCPD in 2005 due to assault and battery by officers and involved in another similar incident in 2007 where he spent time in 2007 and eventually settled the claim. In 2011, he was again assaulted and battered with a lawsuit again starting against the NYPD and Plaintiff is unaware if it could be the same officers involved in precious assaults.
