One of the defendant officers aimed his weapon at Phillip Doyley and shouted for him to get on the floor, and Phillip Doyley obeyed the officer's instruction. Latoya was awakened by all of the commotion and was ordered to get on the floor as well, which she complied with and both Phillip and Latoya Doyley were placed under arrest. While both Latoya and Phillip were handcuffed, one of the officers asked if Andrew Doyley was present at the residence and Phillip answered in the negative then asked for a warrant. Officer Agosto refused to present a warrant at that time however he stated that he would show the warrant at a later time. The defendant officers and Phillip went back-and-forth about Andrew's whereabouts to no avail. The defendant officers searched Andrews room, then demanded that Phillip call Andrew and request he come home, and Phillip called Andrew. Phillip was able to reach Andrew and told him to come home, after which the officers took the handcuffed Phillip outside of the residence and Latoya remained in the home. Phillip was then placed in a van and driven three blocks away by PO Khan. Andrew did not arrive for sometime so the Officers ordered Phillip to continue to call his son and give a false story to entice him to come home. After nine phone calls in a two and a half hour period, Andrew finaly returned home and was placed under arrest. Once Andrew was placed under arrest, Phillip and Latoya had their handcuffs removed. The officers then requested Phillip and Latoya sign the warrant, which both refused to do until the officers threatened to call ACS to take their other children away. The two officers then flipped Plaintiff over and dropped him hard, face first onto the ground. An officer then placed a knee on Plaintiff's head while another knelt down on Plaintiff's legs. On officer kicked Plaintiff in his left ribs twice. Plaintiff was handcuffed and kicked twice in his left ribs again. Plaintiff yelled \"Report police brutality\" and was kicked twice in his right ribs and once in his lower back. NYPD Officer Mao threatened to taser Plaintiff if he spoke out again. Plaintiff was transported to a hospital and arraigned there on June 7, 2013.
