When Plaintiff reached the intersection, he observed police officers at the intersection blocking and redirecting traffic. When Plaintiff approached the intersection, he called for Defendant Sergeant Viligance and requested he help direct him in the direction of his home, due to the traffic redirection. Defendant Sergeant Viligance replied “I am going to arrest you” and then forcefully opened Plaintiff’s driver’s side door and violently and forcefully proceeded to pull the Plaintiff by his arm out of his vehicle, while Plaintiff’s vehicle’s gear was still in the “Drive” shift and while the Plaintiff was still restrained by his seat belt. Plaintiff changed the vehicle’s gear to “park” and released his seat belt while being violently and forcefully pulled out of his vehicle by Defendant Viligance. Plaintiff was forcefully taken into a marked police vehicle where handcuffs were placed very tightly arounds his wrists. Plaintiff was then violently pushed into the back seat of another marked police vehicle. Plaintiff was arrested and charged with disorderly obstruction of vehicle traffic.
