While being arrested, the plaintiff was bitten by police K-9's, pushed against a metal fence and forcefully moved back and forth sideways.  The defendant police officers overreacted to a non crime situation, deploying helicopters and K-9's, ultimately resulting in physical injuries (unspecified) to plaintiff and to a lesser extent his grandmother.  Since the arrest, plaintiff claims he has been harassed by members of the NYPD through unwarranted stops and searches.\n\nOn February 19, 2016, plaintiff was pulling out of the driveway of his aunt's house in Brooklyn when he was pulled over by an NYPD officer and asked to show his license.  Plaintiff complied and the officer apparently ran the license and came back to plaintiff's car informing him that there was an \"I card\" issued for him and that he was under arrest.  Plaintiff was taken to the precinct in Brooklyn where he was held overnight and transferred to Central Booking the next morning.  Plaintiff was then transferred to the 105th Precinct, the same precinct involved in harassing plaintiff in 2007.  Plaintiff was told he was being taken to see a \"familiar face,\" defendant detective Shawn Ward.  In 2007, both plaintiff and his grandmother had sued defendant Ward for his physically abusive actions.   Defendant Ward began interrogating plaintiff despite being told by plaintiff's counsel that he knew nothing of the \"bogus\" criminal charges against him.  Later on February 20, 2017, plaintiff was transferred to Queens Central Booking and charged with Criminal Sale of a Controlled Substance in the Second Degree, Criminal Sale of a Controlled Substance in the Third Degree (2 counts), and Criminal Possession of a Controlled Substance in the 7th Degree.  Plaintiff was released on his own recognizance, despite the gravity of the crimes charged.  Against plaintiff's wishes, plaintiff's counsel accepted an ACD on his behalf on March 13, 2017.  On September 13, 2017, all charges against plaintiff were dismissed.  On October 12, 2017, plaintiff moved the Court to withdraw his plea to an adjournment in contemplation of the dismissal and to restore the charges against him so he could fight them to a full dismissal on the merits. On information and belief, both of the Caucasian individuals present in the car were in possession of quantities of heroin, and made a deal with the police to falsely accuse Plaintiff of having sold them the drugs and were later released from custody with Desk Appearance Tickets. The police officers made false allegations against Plaintiff. PO Resto falsely alleged that he saw an exchange of some sort between Plaintiff and one of the two Caucasians in the front seat of the car before police approached the vehicle. POs Erik Nelson, Eric Sonnenberg, Resto and Brian Ritto complained, or made false allegations, about Plaintiff assaulting them; upon information and belief, those claimed injuries were sustained while unjustifiably beating Plaintiff. Wagner first claimed that he stopped Mr. Anderson for speeding. He then changed his reason and claimed Mr. Anderson failed to stop for a stop sign. He then changed his reason again and claimed he stopped Mr. Anderson for his van's allegedly tinted windows. Sergeant Milligan (Sgt. Milligan) arrived and unlawfully searched Mr. Anderson's van. There was nothing illegal or suspicious in the van. P.O. Wagner and Sgt. Milligan falsely issued Mr. Anderson a summons for transporting building materials. On or about December 26, 2011, P.O. Wagner falsely testified before a criminal Court that he pulled Mr. Anderson over for failing to stop at a stop sign. On that day, all charges against Mr. Anderson were dismissed. Since August 12, 2011, P.O. Wagner, Sgt. Miligan and officers of the 105th, 107th and 113th Precincts have continually harassed, stopped, searched, terrorised, assaulted, battered and brutalised Mr. Anderson. \n\nOn August 19, 2011, Lieutenant Messina (Lt. Messina), 113th Precinct, stopped Mr. Anderson's van without cause and falsely alleged that it was because there was scrap metal in the van. Lt Messina requested consent to search the van, which Mr. Anderson peacefully declined, yet Lt. Messina forced open the van and searched it anyway. Nothing resulted from the illegal search. \n\nOn August 25, 2011, Police Officer Fletcher (P.O. Fletcher) and Sergeant Armstrong (Sgt. Armstrong) stopped Mr. Anderson's van without cause and falsely alleged that it was because Mr. Anderson was driving with a malfunctioning brake light. The light has been fully functional at all times. Mr. Anderson was not issued a summons or a ticket. \n\nOn August 26, 2011, Police Officer Moore (P.O. Moore) stopped Mr. Anderson's van without cause. P.O. Fletcher arrived at the scene and warned P.O. Moore that Mr. Anderson would record the event on video. Both officers fled without any explanation for stopping Mr. Anderson and no summons or ticket was issued to him.\n\nOn September 7, 2011, as Mr. Anderson was attempting to his parked van, a NYPD Narcotics Division van drove up to him and several officers exited including Police Officer Tate (P.O. Tate) and Police Officer John Doe (name unknown) (P.O. Doe). P.O. Tate forcefully grabbed Mr. Anderson's arm to prevent him from entering his van, and obscured the number on his shield with a black band in an attempt to obscure his identity. Mr. Anderson asked for the shield number and P.O. Doe state that it was \"911\". Both officers searched Mr. Anderson's van without cause. Mr. Anderson called 911 to report this police abuse. Both officers fled  and no summons or ticket was issued to Mr. Anderson.\n\nOn September 16, 2011, a neighbour was returning a carjack to Mr. Anderson, which he'd previously borrowed. Detective Kelly (Det. Kelly) and Police Officer Nelson (P.O. Nelson) pulled up in an unmarked NYPD vehicle and unlawfully stopped Mr. Anderson without cause. The officers attempted to search Mr. Anderson without cause and threatened to arrest him. They also cursed Mr. Anderson and forced him to produce identification. They falsely alleged that they had observed another person hand contraband to Mr. Anderson. The officers unlawfully handcuffed Mr. Anderson too tightly (cuffs without a tightening-prevention mechanism) and painfully restrained his arms behind his back. They also threatened Mr. Anderson and repeatedly cursed at him. Both officers assaulted Mr. Anderson and battered him on his head, torso and body. They unlawfully struck him with closed fist, feet and foreign objects. Det. Kelly admitted that he was arresting Mr. Anderson in retaliation for Mr. Anderson's repeated complaints about police misconduct. Mr. Anderson was placed in the unmarked vehicle, driven around, and then transferred to an unmarked police van. He was then driven while detained for approximately 2.5 hours as the officers searched for other innocent citizens to arrest to fulfil a quota. Mr. Anderson was taken to the 113th precinct and falsely imprisoned for more than 24 hours. Both officers made false representations and initiated criminal proceedings against Mr. Anderson.
