Plaintiff was looking for parking when she was forced to stop because an ambulance and police car were stopped in front of her. Plaintiff had no other way to move due to the cars parked on both sides of the road. Defendant Officers Teng and his partner Doe arrived thereafter and activated their lights, suggesting they wanted the vehicles to move which was physically impossible. Defendant Officer Teng then approached Plaintiff Peartree's car screaming and opened Plaintiff Peartree's car door while indicating where he wanted Plaintiff to move. Plaintiff Peartree noticed her son crying and said to Defendant Teng that she did not want him to drive her car. Defendant Officer Teng then pulled up short, pulled out his handcuffs, and grabbed Plaintiff; in front of Plaintiff's son, Defendant Teng swept Plaintiff's feet, knocking her to the pavement, and forcibly arrested her. There was no indication that Plaintiff was engaged in any criminal conduct or any reasonable belief or probable cause for Defendant Teng to arrest Plaintiff. \nPlaintiff was transported to a nearby vehicle, then to a local area station house, and eventually transported to Central Booking in Bronx County where she was imprisoned for many hours. Defendant Officer Teng claimed that Plaintiff was deliberately blocking traffic, refused to move her vehicle, and resisted arrest when she flailed her arms (when she never did). Plaintiff was subsequently charged with one count of Obstructing Governmental Administration and one count of resisting arrest. Defendant Officer Teng issues a moving violation charging Plaintiff with failure to yield to an emergency vehicle. Officer Doe, who was present at the scene, did not make any attempt to intervene.
