The police officers grabbed Plaintiff by the arm, ripped him out of bed, and threw him to the ground. Several officers, including Officers Monserrate Badillo, Michael Leclair, Billy Acosta, and Jack Palimeni punched Plaintiff in the ribs and back, grabbing and twisting his arms and legs and choking him while yelling obscenities. Police Officer Martin McBride entered the room and instructed the officers to stop, and the officers escorted plaintiff, covered in blood and only in underwear and an undershirt, to a van outside. One of the officers punched Plaintiff as he was getting into the van. When Plaintiff cried and asked why he had been attacked, an officer responded, \"shut the fuck up or I will take you somewhere and fuck you up some more\".\n\nPlaintiff was taken to the New York State Division of Parole, and after telling his parole officer that he needed medical attention, EMS arrived. Plaintiff did not go with EMS, because a police officer told him it would slow down the process of seeing a judge and being released. Officers in the precinct pointed and laughed at Plaintiff. Plaintiff was eventually taken to the hospital and instructed by a police officer to put on scrubs and slippers, but Plaintiff did not receive medical care at the hospital. Plaintiff was taken to the New York City Criminal Court, where a court officer instructed police that Plaintiff could not be seen by the judge in scrubs and slippers. The officers gave Plaintiff alternative clothing, and Plaintiff was seen by the judge.
