Plaintiff's vehicle was then subjected to a full search by Defendant Officers despite a lack of any reasonable suspicion causing damage to its interior. The search did not reveal any evidence of criminal or unlawful activity. Defendant Officers then transported the Plaintiff to the nearby precinct, where he was charged with criminal possession a controlled substance in the seventh degree. Defendant Officers provided false and misleading testimony regarding the facts and circumstances of Plaintiff's arrest. In particular, Defendant Officers falsely claimed that they had observed the Plaintiff inside a vacant apartment in possession of crack cocaine. As a result of Defendant Officers' actions, Plaintiff spent approximately thirty-six hours in custody and spent approximately six months making numerous court appearances. The officers ran into each room, kicking in the doors with their guns out, screaming “hands.” Plaintiff Era Habersham was handcuffed. After this, the police began cuffing his daughter and sons. The officers then put Plaintiffs in a van and drove to the 30th Precinct. The officer placed two sons in a cell and handcuffed Plaintiff Era Habersham and his daughter to chairs. They were all then taken to 100 Centre Street. The Officers then took the sons and daughter. Plaintiff Era Habersham was taken to Bellevue Hospital because of his diabetes and rheumatoid arthritis. After Mr. Habersham returned to Central Booking, the District Attorney indicated that he would not process him and not prosecute the children. Plaintiff spent 6 days at Manhattan Detention Center. On June 23, 2010, the Judge lowered plaintiff's bail to $1,500. Plaintiff posted bail and was released. After 10 court appearances, on June 7, 2011, all charges against plaintiff were dismissed.
