Vincent and Grace Rosero-Tapia were not wearing masks at the subway station when a city-wide COVID-19 mask mandate was in effect. Plaintiff approached the officers and verbally engaged them about their failure to wear masks on the subway platform for about 1 to 2 minutes. In response to Plaintiff's repeated requests towards the officers to put masks on, Officer Vincent responded by alternating between sarcastically pretending he could not hear Plaintiff through Plaintiff's mask and ignoring Plaintiff. After the verbal back and forth, Officer Vincent physically seized Plaintiff by grabbing his clothes, and forced him to the exit of the station, telling him he was \"being disruptive.\" Officer Rosero-Tapo assisted Vincent by walking along with Officer Vincent and holding the emergency exit door open for Vincent to eject Plaintiff from the subway station. The officers refused to provide their names and badge numbers when Plaintiff inquired. A bystander recorded part of the interaction and posted the video online. The video went viral and then-NYPD Commissioner Shea asked the officers involved be disciplined. Defendant Officers told Plaintiff he was in violation of curfew and to go home, to which Plaintiff responded that he was homeless. Defendant Officers punched Plaintiff in the stomach, smashed Plaintiff's face into a wall, and slammed Plaintiff to the ground without Plaintiff's consent. Defendant Officers handcuffed Plaintiff's hands behind his back in an excessively tight fashion, which resulted in Plaintiff's wrists sustaining contusions, swelling, and loss of feeling. Plaintiff repeatedly requested that Defendants loosen the handcuffs, but Defendant Officers ignored all of Plaintiff's pleas. Plaintiff was transported to the precinct where they were subjected to a humiliating strip search in which they were forced to completely disrobe. No contraband was found during the search. Defendant Roserotapia signed a criminal complaint against Plaintiff in which they knowingly affirmed the truth of the fabricated allegations, namely that Plaintiff was in violation of curfew even though Plaintiff was homeless. Defendant Officer Roserotapia further charged Plaintiff with possessing a gravity knife which had been legal to possess in New York State since former Governor Cuomo lifted the gravity knife ban on May 30, 2019.
