Plaintiff attempted to run home, but NYPD Detective Joseph Scialabba pointed a firearm at Plaintiff and told Plaintiff he would shoot if Plaintiff moved.  Plaintiff laid down and willingly submitted to rear-cuffing.  Det. Scialabba applied the handcuffs tighter than necessary.  Det. Vargas and P.O. Wolvers caught up and kicked Plaintiff in the back of the head, breaking one of Plaintiff's front teeth, and otherwise badly beat him.  They then dragged Plaintiff across the pavement by the handcuffs.  When Plaintiff declined to provide his name at the precinct, Det. Vargas booked Plaintiff under an invented name, and Plaintiff was charged with marijuana possession, resisting arrest and false personation (based on the name that Det. Vargas invented).  Plaintiff was arraigned, had bail set and taken to jail. Plaintiff was searched and his phone taken (it was never returned).  Plaintiff was held in a police van for about four hours while it collected other prisoners.  He was taken to the 47th Precinct, where he was strip-searched.   Defendant Officer Anthony Schaeffer swore false statements that Plaintiff possessed and distributed marijuana.  Plaintiff had to return to court five times before charges were dismissed on April 29, 2013.\n\nOn June 13, 2012, Plaintiff was walking home from the store when police officers pulled up, put him against a wall, searched him without consent, arrested him, and again put him in a police van for four hours.  No drugs were found.  Officers took $30, which was not returned.   After eventually arriving at the 46th Precinct, Defendant Officer Jerry Wolvers falsely swore charges for sale of crack.   Plaintiff was held for over 36 hours before arraignment. Meanwhile, Defendants, acting in concert, misrepresented to prosecutors that Plaintiff sold and possessed narcotics, resisted arrest, and was disorderly.
