Bradley indicated that he wanted to leave with Mr. Joseph, but Ms. Estrada did not want Bradley to leave. After unsuccessfully trying to grab Bradley away, Ms. Estrada proceeded to call 911, telling the police that \"this man is trying to leave the park with her son.\" The police did not respond to the first 911 call. \n\nMs. Estrada and Ms. Nieves' argument escalated into a physical confrontation, where Ms. Nieves suffered a cut that caused her to bleed as a result. Ms. Estrada then called 911 the second time, this time stating that Mr. Joseph pulled out a gun and pointed it at her and Bradley. The police appeared soon after and placed Mr. Joseph in handcuffs. After searching the area and finding no weapon or corroborating witnesses, the police released Mr. Joseph. \n\nWhile Mr. Joseph was being arrested, someone called his mother, Michelle Clarke, and informed her of the arrest. When she arrived at the park and inquired as to the status of her son, she was told by NYPD Officer Toribio to shut her mouth. When she asked him for his name and badge number, he put his chest into her face, pushed her into the RMP, and placed her under arrest. After Mr. Joseph asked why his mother was being placed under arrest, the officers turned him around and placed him back under arrest. He was initially incarcerated for about a day, but was incarcerated by parole as a result of this case later for 115 days. Defendant officers then threw Plaintiff on the ground, pepper sprayed him, and dragged him on the concrete. At the precinct, the officers swore they witnessed Plaintiff resisting arrest, acting disorderly, and consuming alcohol. During interrogation, Plaintiff objected to his arrest and questioning. One of the defendant officers held Plaintiff up by his arms while another struck Plaintiff in the face a number of times. Plaintiff was taken to the hospital for treatment of his injuries. Eventually Plaintiff was arraigned and received an ACD. \n\nOn September 23, 2014, Plaintiff was again approached by NYPD Officers—this time Officers Ostrander, Polanco, Muratovic, and Malone—and told he had been seen drinking outside, which Plaintiff denied. One of the defendant officers slammed Plaintiff into the ground and sprayed pepper spray close to Plaintiff’s face. The defendant officers then began punching and kicking Plaintiff, and dragged him across the concrete. The defendants twisted Plaintiff’s arms roughly behind his back. Defendants searched Plaintiff but did not recover anything. Plaintiff was taken in for medical treatment.
