NYPD officers, including Mohammad Shabaz, Raphael Sylvestre, and Sergant Wiss Emile, approached the plaintiff without reasonable suspicition and asked him to use a different staircase in the subway station. He complied, but defendant Shabaz grabbed him by the neck and threw him to the ground. The police then searched him without his consent, handcuffed him, and placed him under arrest. The officers refused to tell Ruiz the reasons for his arrest. MTA surveillance cameras recorded the incident, and the police only turned their body camera on after the arrest. Ruiz was then transported to the TD-33 precinct and was photographed, fingerprinted, and detained in a cell before being transported to Kings County Central Booking. The police falsely told the DA's office that the plaintiff had  committed a crime, on June 30 at approximately 8:00PM, he was arraigned and charged with Menacing of a Police Officer and other related charges. Bail was set at $2,500, and Ruiz was unable to post it, so he was transported to Rikers Island. \nOn June 30th, there was a heat wave and Ruiz was kept in the prison under excruciating conditions. Then on July 4th, Ruiz was able to post bail and was released. He was forced to appear before court approximately 9 times before charges were terminated favorably on February 28, 2019.
