While exiting the store, Plaintiff was attacked by seven individuals after one of the attackers yelled his name. Plaintiff was kicked and hit multiple times for two to four minutes while laying on the ground in the fetal position. During the assault, one of the men yelled \"Where's the gun?\" repeatedly, to which Plaintiff replied, \"I don't have a gun!\" One of the officers eventually shouted, \"He has no gun!\" One of the men, Detective Oronges, reached into his coat pocket, pulled out a gun, and said, \"This is your gun.\" Plaintiff denied that it was his gun, and Det. Oronges stated, \"This is your fucking gun.\" The men then handcuffed Plaintiff, picked him up off the ground, and took him to an unmarked police car while the Plaintiff was bleeding excessively from a gash on his forehead. While being transported to the 19th Precinct, Det. Orongoes stated, \"You can take a beating,\" to which Plaintiff replied, \"Are you guys Irish?\" Det. Orongoes said, \"No, I am Spanish,\" but another officer said that he was. Plaintiff asked, \"This is how you treat Irish people?\" Det. Orongoes replied, \"Oh you really take your Irish heritage seriously,\" to which Plaintiff agreed. Upon seeing Plaintiff's condition as he entered the precinct, the Captain on duty ordered the officers to call an ambulance. Det. Orongoes stated to Plaintiff, \"W're not going to any fucking hospital. You tell the ambulance people you don't want to go. We don't want to be stuck there all night. And you do what we say or we will give you another beating.\" When the ambulance arrived, Plaintiff refused multiple times to go to the hospital, telling the EMT that he just slipped and fell. Plaintiff was fingerprinted and photographed and taken to Central Booking, where an officer in the receiving room expressed incredulity about bringing Plaintiff in given his bloody condition. One officer then wiped and scrubbed Plaintiff's neck and face violently with wet paper towels for several minutes before taking Plaintiff into the receiving room.
