After he exited the post office, entered his automobile and started the engine, Officer Rafael Sanz approached the vehicle and gestured Plaintiff open the driver's side window. Officer Sanz then advised Plaintiff that he was going to write up a summons and requested Plaintiff's license and registration for the vehicle. Plaintiff explained he was picking up a package and asked what he did wrong. Instantaneously, Officer Sanz opened the driver door and attempted to force Plaintiff out. He called for backup and called Plaintiff a racial slur. Officer Wanda Schmelter arrived at the scene with other officers. Officer Sanz continued to forcibly remove Plaintiff from his vehicle. Officer Schmelter then sprayed Plaintiff's eyes with mace. Officer Sanz threw Plaintiff to the ground and repeatedly punched and kicked Plaintiff. Officer Sanz handcuffed Plaintiff, and Officer Schmelter transported Plaintiff to the police vehicle. Plaintiff was held in a cell at the precinct. Officer Sanz advised Plaintiff that he was going to be charged with assault, obstruction of governmental administration and resisting arrest. After Plaintiff was released on his own recognizance, Officer Sanz intimidated, harassed and annoyed Plaintiff at Plaintiff's residence. On October 24, 2013, the criminal proceeding was adjourned in contemplation of dismissal.
