At approximately 10:45 PM, Plaintiff got off the train at the Morgan Avenue station and was approached by two NYPD officers. He asked the officers why he was being stopped and began removing his jacket to show he had nothing illegal in his possession. Within a minute, two additional officers responded to the scene and took the Plaintiff to the ground. The Plaintiff was immediately handcuffed behind his back and he repeatedly informed the officers that the cuffs were very tight and that he was not resisting. The officers then carried the Plaintiff up two flights of stairs and transported him to the precinct. \n\nThe Plaintiff was left on a bench near the intake area, where he spotted his arresting officer and he then spit in his direction. Another officer saw the Plaintiff spit and stated \"no one spits at a cop\" and then punched the Plaintiff in the face. The Plaintiff fell on his side on the bench and was then taken to the ground, still handcuffed, and was repeatedly struck by Defendant officers. The Plaintiff was eventually thrown in a cell where he lost consciousness. When he woke up, the floor of the cell was covered in blood, and an officer came inside the cell and called for medical personnel. The Plaintiff was taken to the Interfaith Hospital Center by ambulance where he was treated for multiple injuries, including: a cut above his eye which required stiches, a chipped tooth, a cut to his mouth and wrists, and a lump on the back of his head.
