A man leaving the building held the door open for Mr. Siler, and as Mr. Siler approached the door, a Defendant undercover NYPD officer in plain clothes, who did not identify himself, chased Mr. Siler into the building, up to the roof, and down the fire escape to the building's backyard. Once Mr. Siler reached the backyard, a group of individual defendant officers standing behind a gate shouted at him to get on the ground, while one pointed his gun at him. Mr. Siler lay on the ground. For a few minutes, the defendants tried to figure out how to get around the gate and into the backyard. During this time, they continued shouting at him. This include curses and threats to shoot him if he moved. When one defendant finally reached Mr. Siler, he kicked and stomped Mr. Siler repeatedly in the shoulder, torso, and head, and viciously pulled Mr. Siler's arm behind his back while still applying force to his prone torso. That defendant then handcuffed Mr. Siler behind his back and took him to the front of the building. There, one of the defendants strip searched Mr. Siler, and inserted his fingers into his anus to search his anal cavity. No drugs or contraband were recovered from this search. \nMr. Siler was placed in a police van, where he was kept for about six hours while the police picked up other arrestees. Then, he was taken to a precinct, where he was again strip searched. This search involved an order to Mr. Siler to manipulate his genitals as well as a visual inspection of his anus. At the precinct, Defendant NYPD Detective Harris tried to convince Mr. Siler to confess to selling drugs. After a few hours at the Precinct, Mr. Siler was taken to Central Booking. The DA declined to press charges. Plaintiff was brought before a judge on a separate earlier unresolved charge, which the judge dismissed on the spot, setting Mr. Siler free immediately. Plaintiff was arraigned on April 3, 2012, but was unable to post bail, so he remained incarcerated until September 26, 2013, when he was released on his own recognizance.
