At the time, plaintiff was emotionally disturbed and had brandished a machete in front of his sister and indicated he would hurt himself.  When the police arrived, plaintiff dropped the machete and ran before being stopped by police at gunpoint.  Officer Erdaide then fired a single shot at plaintiff, shattering his femur bone, which required multiple surgeries and a metal rod implant.
