Plaintiff did not have any conversation with any person other than his friend and the cashier, and did not have any prescription medications on him. Plaintiff sat in the restaurant for approximately 10 minutes when Det. Alexander Kalogiros, Det. Ivan Rodriguez, Det. Thomas Pesick, and PO John Doe approached and told him to leave the restaurant. Plaintiff did so and was arrested and searched upon exiting. Plaintiff asked why he was arrested and officers brought him to a handcuffed individual in a patrol van. Plaintiff had never seen this individual before, and the individual stated \"that's not the guy that sold me the drugs. That's the wrong guy.\" POs told the individual to \"shut up\" and transported Plaintiff for approximately 4 hours to the 33rd Precinct then the 25th Precinct approximately 3 hours later. Plaintiff was arraigned on March 1, 2014 at which point he learned he was being charged with criminal sale of a controlled substance. Plaintiff was unable to make bail and was incarcerated at Rikers Island until the case was dismissed on March 6, 2014. As a result of the arrest, Plaintiff's family kicked him out of the house and rendered him homeless for a period of time.
