Plaintiff called defendant White, who told him to appear at the 44th precinct. Upon his arrival, the Plaintiff was placed under arrest based on an accusation that he committed a robbery at knife-point. The defendants did not produce a warrant for his arrest. He was handcuffed, fingerprinted, and placed in a cell. The handcuffs were placed excessively tight and held in place for several hours, resulting in blood loss, numbness, and superficial bruising. The Plaintiff was assaulted and battered by the arresting officers. Detective James White, Officer Claudio Velez, Officers Calvin Black, Jason Valentino, and John Ortiz, Sergeant Letty Donley, Ray Fuller, Sergeant Jesse Hernandez, Vincent Trozzi, and Michael Bopp verbally abused and intimidated the Plaintiff. He was transported to Central Booking where he was held for 24 hours, and then he was released. \n\nThe Plaintiff told the officers that he was at work at the time of the crime and gave the name and number of a supervisor who could confirm his alibi. He also provided his metro card so that the officers could verify that he was not near the location of the alleged crime at the time of the offense, but the officers did not attempt to verify his innocence. The Plaintiff also learned that he did not fit the description of the robber. His roommates informed him that previously officers had come to his apartment regarding the same allegations and showed the robbery victim a lineup of his roommates. Plaintiff invited him into the car to talk while he waited for his brother. Plaintiff noticed a police car pull up behind him so he moved his car to a parking spot. As he parked his vehicle, Plaintiff observed the police car followed him an an officer was approaching. The unnamed officer advised Plaintiff he did not pull out quickly enough from the double parking spot and asked for his license and registration. The officer then told Plaintiff to exit the vehicle and when Plaintiff asked why a second officer told Plaintiff to \"get the fuck out of the car,\" reached in through the driver's side window, and punched Plaintiff in the face. A third officer broke the passenger side window with his baton and pulled Plaintiff's friend from the passenger seat. Additional POs arrived as Plaintiff was pulled out of the car and dragged to the street. Approximately 15 - 20 POs surrounded Plaintiff and began viciously punching him, stomping on him, and beating him with various hard objects. After approximately 5 minutes of beating Plaintiff, who had pre-existing loss of sight in his right eye, officers took each of Plaintiff's arms and another officer hit him in the left eye with a baton. \n\nPlaintiff passed out and when he came to, with blood dripping down his face, POs handcuffed him and transported him to the 44th Precinct. There Plaintiff immediately requested medical attention but was held in a cell for approximately 45 minutes until an ambulance arrived and transported him to the hospital. Plaintiff was diagnosed with an orbital floor fracture and a concussion, was throwing up blood, and required stitches for lacerations under his left eye. Once discharged from hospital Plaintiff was taken to Central Booking where he was detained for approximately 24 hours before he was arraigned and charged with Possession of a Controlled Substance, Attempted Robbery, and Resisting Arrest among other charges. Recent medical exams on Plaintiff revealed deviated nasal septum, septal deviation, opacification of ethmoid sinuses, herniation of orbital contents into the maxillary sinus, chronic fractures of the bilateral nose bones, and a chronic left orbital floor fracture with herniation of orbital fat into the superior left maxillary sinus. Plaintiff now has permanent numbness in his cheek and upper lip, blurry vision, tearing from his eyes, eye pain, and nasal drip.
