Plaintiff was speaking to an acquaintance outside of a deli when he was approached by five unmarked police cars, not using sirens or lights. Plain-clothed officers, including Defendant Marcelin and John and Jane Doe 1-8 exited the vehicles, approached Plaintiff, grabbed him by the arms and placed him under arrest without probable cause. Plaintiff was thereafter falsely charged with unlawful Criminal Sale of Marijuana. Plaintiff did not resist arrest. When Plaintiff asked Defendants why he was being arrested, Defendant officers responded that it was part of an investigation. Plaintiff's acquaintance was arrested for approximately five minutes and then released at the scene. Defendant Officer took Plaintiffs identification and asked for his social security, and when Plaintiff asked why his social security was necessary, Defendant Officer began to yell at Plaintiff and told him he could not ask questions. Plaintiff was then patted down without his consent and placed into one of the unmarked cars and taken to the 40th Precinct. \n\nAt the Precinct, Plaintiff requested a phone call and medical attention, which he was denied for two hours. Plaintiff's girlfriend brought his medication for colitis to the Precinct and Defendant Officers denied Plaintiff access to the medication. Throughout his time at the Precinct, Plaintiff asked for medical attention approximately five times and was denied all times. Plaintiff was then transferred to central booking at approximately 1:00 am on September 8, 2019 at which point he finally received medical attention, but still was not given any medication for his condition. Plaintiff again requested medication for his colitis and was again denied. Plaintiff appeared before a judge on September 8, 2019 at approximately 5:00 PM, where the charges against him were dismissed.
