On or about July 22nd, 2020, Malaysa Verdejo informed the NYPD that her Amazon package was taken from her apartment building at 540 West 52nd Street, New York, NY without her permission. One of the defendants--NYPD Police Officer Salvatore Comodo--was directed to investigate Verdejo's claims. Defendant alleges--after talking with someone who worked in the building and after watching the building's video surveillance--that he saw Plaintiff Michael Pacheco taking a package from the area in the building where all packages are placed despite the recording not clearly showing whether Plaintiff took Verdejo's package or not.\n\n From September 15th, 2020 to September 16th, 2020, Defendants Comodo and John Doe searched, handcuffed, and arrested the Plaintiff at his apartment in front of his young daughters, after being informed/seeing the Plaintiff suffered from physical disabilities and warning the Plaintiff that they would place force upon him if he did not comply to being arrested. The defendants then walked the handcuffed Plaintiff through his apartment building, transported him in an NYPD vehicle to the precinct, placed him in a holding cell, and processed him at the precinct. During the processing of the Plaintiff's arrest, all three Defendants--including Sergeant Morris--ignored the lack of probable cause, Plaintiff's attempt to prove he also had an Amazon package delivered that day, and Plaintiff's statements that he was innocent and chose to maliciously prosecute the Plaintiff by continue the Plaintiff's arrest process and having him charged by the District Attorney. On September 16th, 2020, Plaintiff received an arraignment document charging him with the misdemeanor of petty larceny. However, Plaintiff's charges were ultimately dismissed on January 27th, 2021 in Plaintiff's favor.
