Defendant officers pulled behind the vehicle where Plaintiff was sitting, exited, and approached. Defendant officers ordered Plaintiff and Mr. Guzman out of the vehicle and immediately commenced to search Plaintiff and the vehicle. When Plaintiff protested verbally, he was grabbed by the neck, slammed against the vehicle, and punched about the face and head. Thereafter, Plaintiff was handcuffed, arrested, and transported to a nearby precinct without probable cause, even though Plaintiff did not commit any crime or violation of the law. Defendants falsely and knowingly charged Plaintiff with Resisting Arrest, Criminal Possession of Marijuana, and Unlawful Possession of Marijuana. Plaintiff was thereafter held for approximately thirty-six hours before being presented before a judicial officer who ordered Plaintiff released on his recognizance. In connection with Plaintiff’s arrest, the defendants filled out false and/or misleading police reports and forwarded them to prosecutors.
