As the plaintiff prepared to leave the premises, defendant officers Arjona and Charles walked by on their patrol and questioned plaintiff about a nearby closed bottle of liquor. Defendant Arjona advised the plaintiff that he was going to issue him a summons for an open container, however, the plaintiff stated that he had not been drinking, and provided defendant Arjona identification upon request. Plaintiff, in turn, asked defendant Arjona for his identification, which defendant Arjona took offense to what he perceived as a disrespectful comment, and asked the plaintiff if he was an asshole. Defendant Arjona pepper sprayed plaintiff in the face and struck the plaintiff in the legs with an asp. Defendant Charles, wearing gloves, struck the plaintiff in the face. Defendants Arjona and Charles then forced the plaintiff to the ground. Other officers, including defendant Aykac, arrived after plaintiff was handcuffed, and plaintiff was struck about the body. Plaintiff was taken to the PSA 5 Stationhouse, where defendants Arjona, Aykac, and Charles prepared false police reports accusing plaintiff of various crimes, including possessing two bags of phencyclidine [PCP] which defendant Aykac falsely claimed were recovered from a fanny pack belonging to plaintiff. While in custody, plaintiff was treated at Harlem Hospital, where he was found with abrasion and swelling to his left lower leg, abrasion to his right lower leg, pain and swelling to his right wrist, a forehead hematoma, and left periorbital swelling. Plaintiff was eventually taken to Manhattan Central Booking to await arraignment. Plaintiff inquired as to the circumstances and was told to step back.  Plaintiff saw a cell phone fall from his pockets, so she picked it up and tried to walk away.  Plaintiff was then violently thrown to the ground, causing her halter top to fall off and expose her upper body.  As Plaintiff then tried to walk away, other officers threw her into and then over a metal fence, causing injury to her arms as she tried to brace her fall and exposing her undergarments as her legs splayed in the air.   The officers called Plaintiff racist names and tightly handcuffed her.  Plaintiff was eventually taken to Central Booking, charged and released after 21 hours.  While at the precinct, Plaintiff was forces to expose her breasts to show she had no contraband.  Defendant officers Ilbey Aykac, Michael Costa, Joshua Faranda, Thomas McCue, Edwin Reyes and Jesse Ullger all made false statements in reports or to district attorneys.
