Costco engages in a pattern and practice of profiling African American shoppers as suspected criminals. Despite showing the Costco employee and NYPD Officer Jorge Santacruz his receipt, he was searched and arrested without probable cause and taken to the 72nd Police Precinct. Plaintiff was charged with Petit Larceny and Criminal Possession of Stolen Property in the Fifth Degree, based on a false sworn statement by the Costco employee.
