Plaintiff was taken into custody and placed in a lineup but the escort did not identify him. \n\nRegardless, Plaintiff was arrested on or about October 27, 2011, taken into custody, and falsely imprisoned in various crowded cells with no access to water or a working bathroom. Plaintiff was charged with rape and compelled to make multiple court appearances to defend against the false charges. On or about December 31, 2012 the pubic hair was tested and confirmed to not match Plaintiff. On April 11, 2013 Plaintiff's charges were dismissed. Detective Rama did not interview the victim's father, uncle or male tenant who also resided with her in the apartment. The victim's Uncle had a history of sexually assaulting his own daughter. When Detective Rama interviewed the Plaintiff, he denied raping his sister. Detective Rama arrested Plaintiff on March 7, 2011 based only on what the alleged victim had told him and did not rely on any direct or circumstantial evidence supporting the victim's claim. Plaintiff notified prosecutors that his uncle had a history of sexual abuse against young adults, but the prosecutors did not investigate further. Plaintiff's sister could not substantiate to the Grand Jury why she believed it was Plaintiff who had raped her, and she provided additional testimony that was later shown to be false.
