Prior to his arrest, Mr. Holloway was visiting his cousin, George Brown, at his place of business – Mr. Holloway was tightly handcuffed to the point he began experiencing pain and numbness and was also subjected to a search but found no stolen items, contraband, or unlawful items on him. According to Defendant Officers, an individual named Elvira Minode La Torre had informed them that after withdrawing money from a Chase Bank, at approximately 2:30 pm, Mr. Holloway approached her, placed an unknown object to her side, and robbed her of approximately $300. Ms. Torre did not contact the NYPD until 2 hours after the alleged robbery. Ms. Torre initially did not provide any description of the alleged robber except for his sex, race, clothing, and estimated age. Due to lack of a meaningful description, Defendant Officers did not make any arrests until after their initial response. 1 hour later, Ms. Torre contacted Defendant Officers again and pointed out Mr. Holloway (who was 57 years old at the time). Defendant Officers refused to review any of the videos of the location (despite there being an abundance of video evidence) and forcibly arrested Mr. Holloway. Mr. Holloway was detained for a lengthy period of time then transported to Central Booking – during the meeting, Defendant Officers stated to the prosecutors, among other things, that Mr. Holloway committed the charged crime, and, relying upon the police records, reports, and statements, the prosecutors initiated criminal actions against Mr. Holloway.\n\nOn June 29, 2019, Mr. Holloway was arraigned – bail was set to secure his release. As Mr. Holloway could not make bail, he was transferred to Rikers Island and incarcerated for several days. The prosecutors subsequently reviewed the video evidence and found neither Ms. Torre or Mr. Holloway on any of the videos.
