Plaintiff did not leave, explaining to the POs that he was not smoking--he was waiting for his partner to leave work. The POs left, then returned some minutes later, demanding Plaintiff's ID and asking what was in his bag. Plaintiff asked why they needed his ID when he was not doing anything wrong. Four POs surrounded Plaintiff, continually demanding his ID. One of the POs suddenly said something to the effect of \"let's get him,\" and one of the POs grabbed Plaintiff's arm from behind. The POs then forcibly subdued Plaintiff, handcuffing him, punching him in the face, and putting him in a chokehold. The entire incident was on videotaped.\nPO Martinez signed a misdemeanor alleging facts that he knew to be false, specifically that Plaintiff was smoking a marijuana cigarette on public park grounds, and with skewed details around Plaintiff's refusal to produce his ID. Plaintiff was arrested on October 12, 2022, and released on October 13, 2022.
